New Indictments in Cavaness Killing |

After
having one indictment thrown out a month ago, a Kodiak grand jury has returned
two indictments in the killing of a Kodiak resident in 2008. Chawn D.
Summerall and Joshua R. Erickson were both indicted Wednesday on second degree
murder and first degree assault charges in the killing of then-41-year-old
Darrell Cavaness.
An
indictment handed down in June 2009 against Summerall in the killing was
overturned by Superior Court Judge Fred Torrisi on June 1, 2010. In his decision Torrisi
wrote that the indictment relied too heavily on hearsay evidence. That hearsay was
comments made by Erickson to a Kodiak Police officer, who then related them to
the grand jury. Erickson invoked his Fifth Amendment right against
self-incrimination and refused to testify before the grand jury. Now, he is a
co-defendant.
Torrisi, a
Dillingham judge, said evidence that Summerall was also hit with the likely
murder weapon - a 45-inch length of wood - was withheld from the grand jury.
Summerall
and Erickson are accused of beating Cavaness into unconsciousness on the night
of January 22, 2008, in a home on Natalia Way. Cavaness died in an Anchorage
hospital a week later due to severe head injuries.
Summerall
is currently in prison on an unrelated felony DUI charge, but Erickson's
whereabouts are unknown, and a warrant for his arrest has been issued.

Summer in
Kodiak means lots of fishermen and lots of cannery workers. The discussion at
last night's regular Kodiak Island Borough Assembly meeting was what to do with
young people coming into town looking for work who are totally unprepared for
life on the island.

New Budgets in Effect with New Fiscal Year |

The first
day of July may be the middle of summer in Alaska, but for many agencies and
the state government, July 1st is the beginning of a new year.
The start
of Fiscal Year 2011 means state agencies have a new budget and funding for the
next 12 months. Many non-profits and other organizations that get a lot of
their funding from the state or municipal sources also ascribe to the July to
June fiscal year.
Both the
Kodiak Island Borough and the City of Kodiak
begin their new fiscal year on July 1st as well.
When the
Alaska Legislature meets in Juneau
each January, one its prime task is to establish the budget for the coming
fiscal year. So the fiscal year just starting is the one we heard so much talk
about during and immediately after the legislative session.
Many people
who are not used to dealing with the state's 6-month-in-advance fiscal year
have trouble keeping track.
But, it could be worse. The federal
government's Fiscal Year 2011 runs from October 2010 through September 2011.
And, in case you're wondering: Yes,
Kodiak Public Broadcasting Corporation and KMXT begins its new fiscal year
today (July 1st) as well.
